TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of callnhaul.ca (the "Site") and any junk removal, hauling, cleanout, or disposal services (the "Services") provided by Anchor Property Group Inc., operating as Call N' Haul ("Call N' Haul", "we", "us", or "our"). By using the Site, requesting a quote, or booking Services, you agree to these Terms.
1. Quotes Are Estimates
All quotes — including quotes generated from photos, videos, or descriptions you submit online, by text, or by phone — are non-binding estimates only. Final pricing is determined on site by our crew once they can see the actual load, volume, weight, item types, and access conditions.
Your quoted price may change if:

The actual volume or weight differs from what was described or shown

Items are heavier, bulkier, or more numerous than represented

Additional items are added on the day of service

Access requires extra labour (stairs, long carries, tight spaces, no driveway access, disassembly)
-
Items require special handling or attract additional disposal, tipping, or environmental fees
-
Weather, parking, or site conditions materially increase the time or difficulty of the job
Our crew will confirm the final price with you before loading begins. You may decline the job at that point at no charge, other than any trip or minimum charge we have disclosed to you in advance.
Pricing is based on our trailer-load tiers plus applicable surcharges, and all prices are in Canadian dollars and exclusive of HST unless stated otherwise.
2. Booking, Access, and Your Responsibilities
You agree to:

Provide accurate contact details, service address, and description of the items

Have the legal right to dispose of every item you ask us to remove

Be present, or have an authorized adult present, or give us clear written authorization and access instructions

Provide safe, lawful, and reasonable access to the items and a legal place for our vehicle and trailer to park

Clearly separate items to be removed from items to be kept, and clearly label or point out anything that must not be taken

Remove or secure pets, and disclose known hazards such as unstable stairs, mould, pests, needles, or biohazards
Arrival times are estimates. Traffic, weather, disposal-site wait times, and prior jobs can affect scheduling. We will contact you if we are running late.
3. Prohibited and Restricted Items
We are not licensed to transport hazardous or regulated waste. Do not include, and we will not knowingly remove:

Paint, stains, solvents, thinners, adhesives, and aerosols

Motor oil, fuel, gasoline, propane tanks, and other flammables or explosives

Pesticides, herbicides, pool chemicals, acids, and other corrosives or reactive chemicals
-
Asbestos, or material suspected of containing asbestos
-
Medical or biohazardous waste, needles, sharps, blood, or bodily fluids
-
Animal or human remains, and animal or human waste
-
Ammunition, firearms, fireworks, and weapons
-
Radioactive material
-
Contaminated soil, and drums or tanks holding unknown liquids
-
Wet paint, batteries, and other items requiring household hazardous waste depots (we can advise on where to take them)
Some items are accepted only with prior disclosure and may attract additional fees, including appliances containing refrigerant, tires, mattresses, electronics, propane appliances, and large volumes of construction or renovation debris.
If prohibited items are found on site, we may refuse to remove them, refuse the job, or remove only the acceptable portion. If prohibited items are discovered after removal, you agree to reimburse us for all resulting special handling, disposal, cleanup, fines, penalties, and legal costs.
4. Ownership, Consent to Dispose, and Non-Recovery of Items
By pointing out items for removal, you represent that you own them or are authorized to dispose of them, and you authorize us to remove, transport, donate, recycle, or dispose of them at our discretion.
Removal is final. Once items are loaded, they may be immediately compacted, mixed with other loads, donated, recycled, or landfilled. We cannot locate, retrieve, or return items after removal, and we are not responsible for any item removed in error, including items of sentimental, monetary, or documentary value (for example cash, jewellery, documents, collectibles, or data on devices). It is your responsibility to inspect the area and remove anything you wish to keep before we load.
Items we take are not held for you and no bailment is created. We may keep, sell, donate, or scrap removed items without any obligation to you, and any resale or scrap value does not reduce your invoice.
5. Property Damage and Limitation of Liability
We take reasonable care when working on your property. However:

You accept that removing large, heavy, or awkward items can cause incidental marks, scuffs, and wear to walls, door frames, floors, railings, thresholds, and landscaping, and we are not liable for incidental cosmetic damage of that kind, or for pre-existing damage, or for damage caused by pre-existing defects or hidden conditions.

We are not liable for damage arising from access routes, instructions, or item placement you directed, or from your failure to disclose a hazard.

We are not liable for damage to items being removed, since they are being discarded.

We are not responsible for driveway, lawn, sod, interlock, septic, or well damage caused by the weight of our vehicle or trailer where you directed or permitted us to park or drive.
Damage claims must be reported to us in writing at info@callnhaul.ca within 48 hours of the job, with photos. Claims reported after that period may be denied.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Services, the Site, or these Terms is limited to the amount you actually paid us for the job in question. We are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, revenue, data, or business, even if we were advised of the possibility. Nothing in these Terms limits liability that cannot be limited under applicable law.
6. Payment
A 20% deposit is required on all bookings before we can schedule a pickup time. The balance of your invoice will automatically be charged to the credit card on file the moment our technician marks the job as complete, unless otherwise agreed upon in writing.
We accept the payment methods disclosed at the time of booking. HST is added where applicable.
Overdue amounts may be subject to interest at 2% per month (26.82% per year) and to reasonable collection and legal costs. Returned or declined payments may attract an administrative fee.
7. Cancellations and Rescheduling
Please give us as much notice as possible if you need to cancel or reschedule. If our crew arrives and the job cannot proceed — for example nobody is present, access is not available, the items are not ready, or you decline the confirmed final price after we have travelled to the site — a trip charge may apply where it was disclosed to you in advance.
We may cancel or reschedule a job because of weather, unsafe conditions, equipment failure, disposal-site closures, or circumstances beyond our control. In that case we will reschedule or refund any deposit paid for that job.
8. Right to Refuse Service
We may decline or stop any job at our discretion, including where conditions are unsafe, the load is misrepresented, prohibited items are present, access is inadequate, a person on site is abusive, threatening, or impaired, or we reasonably believe the removal would be unlawful.
9. Service Area
We serve Barrie, Ontario and surrounding communities. Jobs outside our regular service area may attract travel surcharges or may be declined.
10. Site Use and Intellectual Property
The Site and its content — text, pricing structures, graphics, logos, photos, and the Call N' Haul name and branding — are owned by us or our licensors and are protected by law. You may not copy, reproduce, republish, scrape, or use them commercially without our written permission.
You agree not to misuse the Site, including by submitting false information, submitting content you do not have rights to, interfering with the Site's operation, or attempting to gain unauthorized access.
By submitting photos, videos, or reviews to us, you grant us a non-exclusive, royalty-free licence to use them to provide the Services, keep records, and promote our business, subject to the marketing opt-out in our Privacy Policy.
11. No Warranty on the Site; Estimates and Content
The Site is provided "as is" and "as available". Pricing tiers, availability, and information on the Site may change without notice and are provided for general guidance. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. We do not provide legal, environmental, or waste-compliance advice.
12. Indemnity
You agree to indemnify and hold harmless Anchor Property Group Inc., Call N' Haul, and our employees, contractors, and agents from any claims, losses, fines, penalties, damages, and reasonable legal costs arising from your breach of these Terms, your misrepresentation of the load, your inclusion of prohibited items, your lack of authority to dispose of items, unsafe conditions on your property, or your instructions to us.
13. Privacy
Your use of the Site and the Services is also governed by our Privacy Policy, which forms part of these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree that the courts of Ontario have exclusive jurisdiction, except that either party may bring a claim in Ontario Small Claims Court where the amount falls within its limits. We encourage you to contact us first so we can try to resolve any issue directly.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and any written quote or invoice, are the entire agreement between us regarding the Services. We may update these Terms at any time by posting a revised version with a new "Last updated" date, and the version in effect when you book applies to that job.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit callnhaul.ca (the "Site"), request a quote, or use our junk removal services.
We handle personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA), Ontario privacy law, and Canada's Anti-Spam Legislation (CASL).
1. Information We Collect
Information you give us directly:

2. How We Use Your Information
We use personal information to:

Prepare and send you quotes based on the photos and details you submit

Schedule, dispatch, and complete junk removal jobs

Communicate with you by phone, text message, and email about your quote or booking

Process payments and issue receipts and invoices

Keep records of loads removed, including disposal and recycling documentation

3. Text Messages (SMS) and Email Marketing
Text messages. By giving us your mobile number through our quote form, by phone, or in writing, you consent to receive text messages from Call N' Haul about your quote, booking, crew arrival, and follow-up. Message frequency varies. Message and data rates may apply. Reply STOP to any text to opt out, or HELP for assistance. Opting out of texts does not prevent us from contacting you by phone or email about an active job.
Email. Transactional emails (quotes, confirmations, receipts) are sent as part of providing the service. Marketing emails and newsletters are sent only with your express or implied consent under CASL, and every marketing email includes an unsubscribe link. You can also unsubscribe at any time by emailing info@callnhaul.ca.
4. Payments
If you pay by card or digital payment, that transaction is processed by a third-party payment processor. Your full card number is handled by the processor and is not stored by us. We retain only the information needed for accounting, such as the amount, date, payment method type, and last four digits of the card.
5. Photos and Job Media
Photos and videos you submit for a quote, and photos our crew takes before and after a job, are used to price the work, confirm scope, document condition, and resolve disputes.
We may use before-and-after job photos in our marketing (website, social media, ads). We remove or avoid capturing identifying details such as house numbers, licence plates, and faces where practical. If you do not want your job photos used in marketing, email info@callnhaul.ca and we will exclude them.
6. Cookies, Analytics, and Advertising
The Site uses cookies, pixels, and similar technologies to keep the Site working, remember your preferences, measure traffic, and measure and target advertising. This may include tools such as Google Analytics, Google Ads, and the Meta (Facebook/Instagram) pixel. These providers may set their own cookies and receive information about your visit, and may combine it with data they hold from other sources.
You can block or delete cookies in your browser settings, and you can limit ad personalization through Google Ads Settings and your Meta ad preferences. Blocking some cookies may affect how parts of the Site function.
7. When We Share Information
We do not sell your personal information. We share it only as follows:

Our crew and staff, so they can complete your job

Service providers who work on our behalf, such as scheduling and CRM software, quote and booking form providers, cloud storage and hosting, payment processors, SMS and email platforms, analytics and advertising platforms, and accounting or bookkeeping support

Disposal, transfer station, recycling, and donation facilities, where required for records or for the items themselves

Insurers, adjusters, lawyers, or accountants, in connection with a claim, audit, or dispute

Government or law enforcement, where required or permitted by law, court order, or lawful request

A purchaser or successor, if the business or its assets are sold or reorganized, subject to appropriate protections
Some of these providers store or process data outside Canada, including in the United States. While information is in another country it may be accessible to that country's courts, law enforcement, and regulators. We take reasonable steps to require comparable protection by contract.
8. Safeguards
We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including restricted access, password protection, and reputable third-party platforms. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Retention
We keep personal information only as long as needed for the purposes described above and to meet legal, tax, insurance, and accounting requirements. Quote requests that do not become jobs are generally kept for a limited period for follow-up and then deleted or de-identified.
10. Your Rights
Subject to legal limits, you may:

Ask us to correct information that is inaccurate or incomplete

Withdraw consent to marketing communications at any time

To make a request, contact us using the details in Section 12. We may need to verify your identity, and we will respond within the timelines required by PIPEDA. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca.

We may update this Privacy Policy from time to time. The "Last updated" date above reflects the current version. Material changes will be posted on this page.
